1.1 For the purpose of the General Data Protection Regulation 2016/679 and any implementing legislation (the “GDPR”), Nordson Corporation and its EU affiliates (“Nordson” or “we” or “us”) will be the data controller responsible for any personal data you may submit to us.
1.2 If you are an individual associated with one of our customers or vendors, the relevant data controller is the Nordson EU affiliate with which the company you are associated with has a contract. A list of each of Nordson’s EU affiliates and the relevant contact details for each are provided in Annex 1 to this Privacy Notice.
1.3 If you are a website user or associated with a prospective customer or vendor, the data controller is Nordson Corporation and can be contacted at the following email address: nordson.privacy@nordson.com.
1.4 Nordson respects your privacy and is committed to protecting your personal data. This privacy notice will apply for our customers and vendors, business contacts and website visitors, and will inform you how we look after your personal data and tell you about your privacy rights and how the law protects you.

2.2 It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

5 IF YOU FAIL TO PROVIDE PERSONAL DATA
5.1 Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.
6 WHAT PERSONAL DATA WE COLLECT AND WHY?
6.1 We are committed to protecting and respecting your privacy. This Section 6 covers the sources and categories of personal data that we collect and process, why we do so, and lawful bases for processing by Nordson.
6.2 Depending on your relationship with Nordson, please find below the relevant section where we describe how we obtain your personal data and how we will treat it.
6.3 This Privacy Notice covers the processing of the following categories of individuals:
- Customers and vendors (individuals or corporate entities). Where customers or vendors are legal entities, this covers employees or representatives of our existing or prospective customers or vendors, partner organisations, suppliers, or service providers

6.4 We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

If you are a vendor, we process your personal data in order to carry out the contractual relationship on the provision of services or products, including vendor onboarding which might involve financial and personal background checks.

Purposes for sharing your personal data
Nordson may share your information with other organisations in the following situations:
a) When we need to share information to provide any product or service you have requested, or that you have provided.
b) For the processing of your payment details and the provision of support services.
c) For the management of our customer or vendor records.
d) For the fulfilment of phone, mail, email and online marketing campaigns, analysis of visitors to our website, distribution of newsletters.
e) To exchange personal data for reporting and global management purposes within Nordson Corporation group of companies.
Government or regulatory authorities
We may also give out information about you if we have a duty to do so or if required or requested by any governmental, or other regulatory authority or similar body, or by the rules of any applicable law or regulation or if the law allows us to do so. Otherwise, we will keep information about you confidential.
Nordson’s Affiliates
Data we collect may also be processed by staff operating outside the European Economic Area (“EEA”) who work with us or for us, or for one of our affiliated companies, suppliers or service providers.
In so doing, the affiliates may be data controllers or data processors of your information. As data controllers, these Nordson affiliates will process your data in compliance with the GDPR and other relevant data protection laws. As data processors, these Nordson affiliates will be bound by Article 28 Processor Clauses of the GDPR and other relevant data protection laws.
Third party recipients
Companies outside the Nordson Corporation group of companies that we may involve for the above purposes are:
a) Our advertising and promotional agencies and consultants and those organisations selected by us to carry out marketing campaigns or email mailings on our behalf, or analyse or evaluate our data collection process or customer service fulfilment.
b) Unaffiliated service providers with whom Nordson may subcontract, such as website hosting companies, and other third-party service providers.
c) Unaffiliated partner organisations with whom we may carry out joint marketing campaigns or events, or operate the website on which information about you is collected. In certain circumstances, those organisations may be independent data controllers or joint data controllers of your information, together with the Nordson Corporation affiliate.
Nordson’s purchasers
Nordson may transfer your personal data to potential purchasers and their advisors, subject to appropriate confidentiality obligations, in the event Nordson decides to dispose of all or parts of its business, in which case personal data held by it about its customers may be one of the transferred assets.
Lawful bases for sharing your personal data
a) Legitimate Interest: We share or disclose your personal data within the Nordson Corporation group of companies because it is in our legitimate interests to do so for group-wide internal management. You have a right to object to sharing your personal data within the Nordson Corporation group of companies. If you do, please send email us at nordson.privacy@nordson.com; Subject Line: Opt Out.
b) Legal Obligation: We disclose your personal data to third parties, e.g. companies outside Nordson, when we use those third parties to provide you Nordson products or services, or if we use their services or products to manage our contact databases or internal management systems.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

(v) Transfers of personal data outside the EU/EEA
Many of our external third parties are based outside the European Economic Area (“EEA”) so their processing of your personal data will involve a transfer of data outside the EEA.
If and when we transfer your personal data outside the EEA (which consists of EU member states and Iceland, Lichtenstein and Norway), we will only do so using one of the following safeguards:
(A) the transfer is to a non-EEA country which has an adequacy decision by the EU Commission European Commission: Adequacy of the protection of personal data in non-EU countries.
(B) the transfer is covered by a contractual agreement, which covers the GDPR requirements relating to transfers to countries outside the EEA European Commission: Model contracts for the transfer of personal data to third countries.
(C) the transfer is to an organisation which has Binding Corporate Rules approved by an EU data protection authority.
(D) the transfer is to an organisation in the US that is EU-US Privacy Shield certified European Commission: EU-US Privacy Shield.
Nordson Corporation has EU-US Privacy Shield in place as an appropriate safeguard for international transfers.

(vi) How long will your personal data be kept by Nordson?
Nordson only keeps the personal data in a form that permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed.
We will generally hold personal data collected for the purposes of complying with various legal obligations and regulations set out in Section 6.5(iii) above for the entire duration of our relationship with our customer or vendor with regard to the provision or purchase of products and services and any applicable regulatory or retention period prescribed by law. We will retain information about you after the closure of your customer account for as long as required for legal, regulatory, fraud prevention and legitimate business purposes.
However, we may retain data for longer periods, if required by law or if we determine it may be required for the purposes of dealing with potential claims.

Nordson will only retain your personal data for as long as you want to receive marketing materials from us. If you decide to opt out or withdraw your consent to our marketing we will no longer use your personal data for these purposes.
Otherwise, Nordson will retain your business contact details for as long as it is necessary for the purposes set out Section 6.6(iii) above (e.g. to carry out our relationship with you).
In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

b) Contact Data, which includes your billing address, delivery address, email address and telephone numbers.
c) Technical Data, which includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
d) Profile Data, which includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.
e) Usage Data, which includes information about how you use our website, products and services.
f) Marketing and Communications Data, which includes your preferences in receiving marketing from us and our third parties and your communication preferences.
We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data, which will be used in accordance with this privacy notice.

Purposes for sharing your personal data
Nordson may share your information with other organisations in the following situations:

Nordson’s Affiliates
Data we collect may also be processed by staff operating outside the European Economic Area (“EEA”) who work with us or for us, or for one of our affiliated companies or service providers.
In so doing, the affiliates may be data controllers or data processors of your information. As data controllers, these Nordson affiliates will process your data in compliance with the GDPR and other relevant data protection laws. As data processors, these Nordson affiliates will be bound by Article 28 Processor Clauses of the GDPR and other relevant data protection laws.
Third party recipients
Companies outside the Nordson Corporation group of companies that we may involve for the above purposes are:
d) Our advertising and promotional agencies and consultants and those organisations selected by us to carry out marketing campaigns or email mailings on our behalf, or analyse or evaluate our data collection process or customer service fulfilment.
e) Unaffiliated service providers with whom Nordson may subcontract, such as website hosting companies, and other third-party service providers.
f) Unaffiliated partner organisations with whom we may carry out joint marketing campaigns or events, or operate the website on which information about you is collected. In certain circumstances, those organisations may be independent data controllers or joint data controllers of your information, together with the Nordson Corporation affiliate.
Nordson’s purchasers
Nordson may transfer your personal data to potential purchasers and their advisors, subject to appropriate confidentiality obligations, in the event Nordson decides to dispose of all or parts of its business. d) Legal Obligation: We disclose your personal data to third parties, e.g. companies outside Nordson, when we use those third parties to provide you Nordson products or services, or if we use their services or products to manage our contact databases or internal management systems.
We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

(v) Transfers of personal data outside the EU/European Economic Area
Many of our external third parties are based outside the European Economic Area (“EEA”) so their processing of your personal data will involve a transfer of data outside the EEA.
If and when transferring your personal data outside the EEA (which consists of EU member states and Iceland, Lichtenstein and Norway), we will only do so using one of the following safeguards:
(A) the transfer is to a non-EEA country which has an adequacy decision by the EU Commission European Commission: Adequacy of the protection of personal data in non-EU countries.
(B) the transfer is covered by a contractual agreement, which covers the GDPR requirements relating to transfers to countries outside the EEA European Commission: Model contracts for the transfer of personal data to third countries.
(C) the transfer is to an organisation which has Binding Corporate Rules approved by an EU data protection authority.
(D) the transfer is to an organisation in the US that is EU-US Privacy Shield certified European Commission: EU-US Privacy Shield.
Nordson Corporation has EU-US Privacy Shield in place as an appropriate safeguard for international transfers.

(vi) How long will your personal data be kept by Nordson?
Nordson will only retain your personal data for as long as you want to receive marketing materials from us. If you decide to opt out or withdraw your consent to our marketing we will no longer use your personal data for these purposes.
Otherwise, Nordson will retain your business contact details for as long as it is necessary for the purposes set out Section 6.7(iii) above (e.g. to carry out our relationship with you).
In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
7.1 We have put in place appropriate security measures to prevent your personal data from being accidentally lost, use or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.
7.2 We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

· Request access to your personal data - Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
· Request correction of your personal data - Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
· Request erasure of your personal data - Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. · Object to processing of your personal data - Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. · Right to withdraw consent - Withdraw consent at any time where we are relying on consent to process your personal data. 11.2 If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis that allows us to do so.

12.1 Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience.
